TERMS AND CONDITIONS POLICY
I GENERALITIES
The present Terms and Conditions Policy (hereafter referred to as “T&C Policy”, “the Terms”) of the company Altalena of Switzerland SA, (hereafter referred to as “The Company”, “we” or “us”) registered in the Swiss Chamber of Commerce under the name Altalena of Switzerland SA, Chemin de Plein-Air 1B, 1180 Rolle, Switzerland, govern the contractual relationships between Altalena of Switzerland SA and the customer (hereafter referred to as “The Customer”, “you”) and apply exclusively to orders placed appropriately by physical entities for their business activity.
II USE OF WEBSITE
Please read these Terms carefully and make sure that you understand them before ordering any
product from our company.
If you do not agree to these Terms, thank you for not pursuing ordering process and accessing our
Website.
You agree that the information you provide when creating your account or placing an order is true
and accurate in all respects. We only use your personal information for the purposes detailed in
our Privacy Policy (eg dealing with orders and accounts, processing payments). You should notify
us of any changes to that information.
Whenever you make use of a feature that allows you to upload content to our Website, or to make
contact with other users of our site, you must comply with these Terms and any applicable law.
Any content you upload to our Website will be considered non-confidential and non-proprietary.
The Company have the right to use, copy, distribute, reproduce, exploit, modify, alter and/or
disclose to third parties any such material for any purpose. We also have the right to disclose your
identity to any third party who is claiming that any material posted or uploaded by you to our
Website constitutes a violation of their intellectual property rights or of their right to privacy.
We may deny you access to the Website at any time in its sole discretion when we believe that
your use of the Website is in violation of any of these Terms, any law or the rights of any third party
or was not respectful to others.
We will not be responsible, or liable to any third party, for the content or accuracy of any content
posted by you or any other user of our site and you hereby agree to be responsible to The
Company and indemnify us against all costs, damages, expenses, losses and liabilities incurred
and/or suffered by us as a result of any claim in respect of your use of the Website.
All content from the Website, unless uploaded by you, including, but not limited to, text, graphics,
logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and
software is the intellectual property of the Company or other relevant third parties.
You may not reproduce, copy, distribute, store or in any other fashion re-use this material
unless otherwise indicated on the Website or unless with a given by the Company written
permission to do so.
III REGISTRATION AND ACCOUNT
In order to be able to use the services proposed by the Company, and in particular to place orders
benefiting from preferential tariffs strictly reserved for our professional clients, the Customer needs
to either create an account on our website which he can modify or delete at any time or send a
direct email to b2b@altalena.ch . The personal information is to be filled in accurately. To falsify
the data for obtaining preferential conditions is considered illegal and will be prosecuted according
to Swiss legislation.
Further to the registration, the Customer will receive a confirmation e-mail. In order to go to “My
account”, the Customer has to sign in with his or her e-mail-address and password. His personal
space gives access to personal information.
IV ORDERS
1. PLACE AN ORDER
For Professional purposes or corporate gifts projects you can benefit from our exclusively reserved
Business to Business Terms & Conditions. After having created an account on the Website or
sending a direct request by email you will be contacted by our representative for further discussions
and order taking. For the moment the Online Shop does not provide the possibility for the
Professionals to place their orders directly online.
The minimum amount of each order is 200 CHF on the models selected from the catalogue, from
500 CHF – you can have personalized designs, created specially to your needs.
Since we do not keep the stock of readymade items and your ordered goods will be specially
manufactured/customised for you, it is not possible to cancel the order once placed.
2. PRODUCT AVAILABILITY
Being a small family run business, offering products personalization services, does not allow our
Company to keep a large stock of readymade items. Hence, our policy is to start the production of
goods once the order was placed, confirmed and paid for. The lead time for product availability for
the shipment will be discussed in each case individually taking into consideration your needs and
order size. But minimum delay should be estimated at 8-10 working days.
In spite of all the precautions taken by The Company to ensure the most accurate information
concerning the availability of the proposed articles (raw material necessary for the production), it
can happen that several items deemed available at the moment of the order no longer are. Should
one or more items of the order be permanently unavailable, we will notify you during the negotiation
stage and try to find a mutually beneficial solution.
V PRICES AND PAYMENTS
Professional customers will get a price list containing preferential tariff in Swiss Francs (within
Switzerland) and EUR (outside of Switzerland). These prices DO NOT include VAT to avoid double
taxation for international orders. VAT of 7.7% will be added at the invoice-issuing stage for all the
orders delivered within Switzerland and Liechtenstein. This is also applicable to prices for
promotional items.
The Company reserves the right to modify prices at any time.
To ensure a smooth cashflow we ask our clients to settle the orders prior to shipment. All the
payments should be done via bank transfer to the account and in the currency that appear on the
invoice. The accuracy of the transaction is entirely Client’s responsibility. If bank commissions are
applicable in case of international transactions it is up to the Client to cover those in full.
Two options of payment scenario are possible:
A. 60% of total amount is transferred prior to production and the remaining 40% when the goods
are ready to be dispatched.
B. 100% is transferred in one payment to minimize potential bank fees.
VI DELIVERY
We deliver to most of the countries worldwide. Shipping costs are the responsibility of the client
and depend on the amount, weight and the volume of the order, the delivery destination and
the carrier.
The shipping cost will be indicated on your order confirmation. You can opt for organizing
the shipment directly from our workshop with your own designated transporter. In that case
no charges will be added.
All dates quoted for delivery are estimated delivery dates only and may be subject to change.
Delivery delays may not give rise to any claims for compensatory damages.
1. SHIPPING WITHIN SWITZERLAND
For Switzerland and Liechtenstein, shipments are done by Swiss Post in economy unless
otherwise specified by The Customer.

2. SHIPPING OUTSIDE SWITZERLAND
For deliveries to any country outside Switzerland duty, sales and import taxes will be charged.
These must be paid by The Customer upon delivery of the goods. Please note that we are not
responsible for fees, charges, duties, tax or other costs applied by customs or other authorities in
your respective country.
Our international delivery charges are straightforward and are based on the delivery location and
the volume of your order. We work with several transport companies, e.g. GLS, UPS, FedEx and
each time evaluate the best proposition available.
For the countries within EU Zone 1* we propose the following conditions:

For the rest of the countries the shipping costs are agreed upon by email during the order confirmation process.
* Zone 1: Germany, Belgium, France, Italy, Luxemburg, The Netherlands, Austria
** The final number of boxes and the total shipping cost will be recalculated upon the order confirmation.
Shipping cost does not include the importation customs clearance fees nor VAT of the destination country
VII RETURN POLICY
Since all the products are manufactured individually for each order and often are customized
as a general rule we DO NOT accept any returns, order cancelations or reimbursement
claims. This practice is entirely within Swiss legislation.
The only exception is made in case of faulty item. All goods that we dispatch have been through
rigorous quality control checks conducted by our responsible employees. Nevertheless, on rare
occasions, an item may be sent out that is faulty. In these circumstances, we will replace the item
if possible or if agreed by both sides issue a credit note or at our discretion provide a refund of the
purchase cost. No shipping costs will be reimbursed. For this action to take place the Customer
has to notify the Company regarding any quality issue with 3 days of delivery. In case of no such
communication your order is qualified as fully executed and no further claims will be accepted.
If you discover a fault please contact us by email stating the problem and sending a digital photo
clearly showing the issue. We will then confirm in writing that the item can be returned or
reimbursed. Please ensure that any item returned to us as “Faulty” is carefully packaged,
appropriate to its value, size, and weight to protect it from the damage in the post. We cannot
accept an item that has been damaged in the post due to poor packaging.
Refunds can only be credited via direct bank transfer to your account.
VIII CONFORMITY OF GOODS
Products are displayed on our Website using digital picture representations of actual items. While the colour reproduction of the products is a close representation, minor differences may arise through this process, however this cannot be considered in any way as a product imperfection. We cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.
IX MODIFICATION
The Company reserves the right to modify the above sales Terms and Conditions from time to time
and every revised version will be effective immediately overriding the previous one. Version 2.0:
01.10.2022.
Conditions pertaining to the use of our website are subject to Swiss regulatory provisions and their
meaning is to be determined in compliance with Swiss law.
X LAW AND TERRITORY
To the extent it is possible to exclude the application of other laws and regulations, this T&C Policy and your use of our Website are governed by Swiss law and you agree to submit to the nonexclusive jurisdiction of the Swiss court. This Website and our Terms have been designed for use within Switzerland and under Swiss law. Whilst we are happy to consider requests for products and enquiries from outside Switzerland, we give no warranty that the use of this Website or the placing of any order from outside Switzerland complies with any applicable non-Swiss laws or regulations. Accordingly, ordering any products or promotions not permitted under your local law is your entire legal responsibility.
XI DISCLAIMER & LIMITATIONS OF LIABILITY
To the fullest extent permitted by law, neither The Company nor any associated company shall be liable to you of any implied warranty, condition or other term, or under the terms of the contract, or in negligence for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of savings), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.
